Divorce and Dissolution

Breaking up is not only hard to do, there are many difficult legal questions that have to be considered. Custody of children and the parental interaction in a broken family is only one factor. Division of marital property, including pension benefits, disposition of real estate, bank accounts and even household items have led otherwise reasonable people into legal battles that cripple them financially and emotionally for years. Our attorneys are knowledgeable, considerate, and always consider the best interest of our clients in a divorce case. They maintain flexibility in their advice to a client when flexibility is needed to resolve the issues of the divorce. Perhaps more importantly, our attorneys are prepared, tenacious, and efficient when court battles over divorce issues are necessary.

Single Parent and Grandparent Custody

It is an unfortunate fact that drugs and careless parenting are common problems in Northeast Ohio. For that reason, it has become more and more necessary for an unmarried parent to obtain custody of a child when the other parent fails to serve the child's best interest. Sometimes a grandparent or other interested relative seeks custody of children when the parents have proven themselves to be unsuitable custodians. We have developed an expertise in these cases and use it to obtain emergency custody to rescue children in danger and plan for and successfully obtain custody of children at risk.

Criminal, OVI and Drug Cases

We live in a time where there is tremendous tension between police authority and citizens. The unfortunate consequence of this tension is a general belief that everyone charged with a crime must be guilty. Nothing could be further from the truth. The Constitution declares that every criminal defendant is innocent until proven guilty and gives criminal defendants a wide range of rights to protect them from overzealous and mistaken prosecutions. Our attorneys understand these rights and work hard to defend anyone charged with a criminal offense; even those who may be guilty. 

Personal Injury

Debt Relief and Mortgage Foreclosure Rescue

Northeast Ohio was hit hard by the economic recession that swept the country. Many people lost their homes, many more would have except for the fact that the federal government and the Ohio Supreme Court in cooperation with the governor implemented programs that permitted mortgage modifications even in cases where the homeowner was years behind in payment. Our office has saved a number of homes that would otherwise have been lost. We have also given advice and provided legal services to people who were buried under consumer debt. For example, we believe our domestic relations clients shouldn't have to seek another attorney to have the will rewritten at the end of the divorce. The attorney that handled the divorce has a more thorough knowledge of the client's situation and legal needs than a new attorney, so it seems more appropriate for us to handle writing a will or, perhaps, an inter vivos trust to protect the client's assets. Appeals

Judges and juries do their best, but they sometimes make mistakes and the wrong side wins a case costing the other money, property or even their freedom in criminal cases where the overwhelming sentiment is to be tough on crime.

Our Office has won a number of important appeals:

State v. Frye, 2007 Ohio 6941: Where our client was released from prison when the Appeals Court decided that he had been subject to an illegal search.

Poole v. Poole, 2014 Ohio 5611: Where Appeals Court overruled the judge who let a father illegally change the name of his daughter after a divorce.

State v. Hoffstetter,  2007 Ohio 6727: Where the Appeals Court denied the prosecutor's attempt to appeal after a jury had found our client not guilty.

In Re: Newsome, 2008 Ohio 2132:  Where the Appeals Court upheld grandparent visitation with a grandchild.

Archer v. Dunton, 2 cases, 2017 Ohio 8846 and 2019 Ohio 1991, Where the Appellate Court ruled twice that a wife was entitled to portions of her former husband's pension benefits.

State v. McCorvey, 2011 Ohio 3627: Where the Appellate Court overturned the judge who approved the illegal roadside search of our client.
